Contestability Period

The time period during which the insurer is not obligated to pay a claim (usually two years, but depending on state law) because of material misrepresentations found in the application or in information obtained by the insurer. A policy becomes “incontestable” when the contestability period is over. Courts refer to this as a “time limit on certain defenses.”
